If your company purchases lead data from a third-party lead provider, collects lead data from a website (even a domain your company owns) or you use an auto-dialer integrated with improveit 360 your company will need to review the latest changes to TCPA.
The Telephone Consumer Protection Act (TCPA) has two major changes taking effect in 2025:
One-to-one consent
This rule takes effect on January 27, 2025 and requires businesses to obtain individual consent from consumers before using robocalls or texts for marketing. This means that businesses can't rely on multi-party consents. The consent must also be "logically and topically" related to the transaction that led to it.
Consent revocation
This rule takes effect on April 11, 2025 and allows consumers to revoke consent in any reasonable manner. This includes using words like "stop", "quit", "end", "revoke", "opt out", "cancel", or "unsubscribe". Businesses must honor these requests within 10 business days.
These changes are intended to strengthen consumer protection and close the "lead generator loophole". They impact a wide range of businesses, including:
- Companies that operate shopping comparison sites
- Companies that purchase leads from shopping comparison sites
- Companies that rely on TCPA consents for autodialed calls or texts
Businesses should review their current consent and revocation practices to comply with these changes. Consult with your legal counsel to see if these FCC changes apply to your business practices.
